Village At Town Center 100 North Ave. Tallmadge Ohio I am of the strongest opinion that if you are with a disability and / or plus 55, or both, DO NOT rent with Testa Enterprises, Inc. from Cuyahoga Falls, Ohio; AKA Testa Real Estate Management, LLC, or the Village of Town Center, LLC, or any of their numerous L.L.C.’s Plus 55 Senior Apartments. I have and continue to experience an abuse that is incomprehensible and condoned, even supported by government agencies, public servants, not for profits, and a local court, with no relief. Testa is deemed more important than those they contracted and aligned themselves to serve. I'm of the opinion I've encountered fraud and corruption. I rise to the definition of disabled according to law. I made simple requests for reasonable accommodations with letters from my doctor, as per the Fair Housing Act. I requested handicap parking, emotional support animals, rental payment adjustment... The accommodations were ignored and no lawful reason was given as to why they were denied, as is required by law. After asking for the accommodations, I was subjected to menacing, perversion, spying, ridicule, harassment, torment, debasement, disdain, unrelenting verbal abuse, the police called on me for parking in a disabled parking spot, unlawfulness, lease violations, and character assassination. I filed two complaints of discrimination with HUD who gave it to the Ohio Civil Rights Commission Akron who tell me they only investigate Fair Housing complaint using Ohio law. No consideration of federal law or the Supremacy Clause in the U.S. Constitution even though the violations are of the Fair Housing Act, a federal act. Too, I was told that Ohio law doesn't cover harassment. The HUD / OCRC complaints resulted into an unlawful retaliatory eviction, with an F.E. & D. claim based in fraud. Testa's lawyers did not identify me as a Housing Choice Voucher recipient and testified I paid full rent. When questioned about the omission of the HCVP contracts in court they denied having any knowledge that I was an HVAC recipient despite having signed contracts. Contracts they withheld from me. The magistrate just listened and took no action, the court proceeded to have me evicted. The court itself lacked subject matter jurisdiction since I was not served properly either by the Testa's lawyers or the local court. I was "evicted" during the Covid epidemic, unlawfully. My legal rights were ignored by willful denial / willful ignorance of the law by both Testa's lawyers and the local court. In addition, it is in violation of the FHAA to evict a tenant when there is an active complaint with HUD / OCRC. I made the Reasonable Accommodation request to Testa's attorney, but the FHA violation and the Reasonable Accommodation to drop the F.E. & D. was also denied with no reason. There was even an attempt to create an agreement in court to where I was required to withdraw the FHA request, but no one signed the agreement. They did not want to create a 3 day notice to evict? The agreement unsigned I'm told became an order, and now stands moot since the court lacked subject matter jurisdiction during these actions. The unlawful retaliatory eviction continued. I was being threatened to comply. The second Charge of Discrimination was made to HUD in August 2019, and eviction action began in September 2019. Management pretended not to have received my rent payment. These Senior Rentals 55 plus are built with IRS / HUD subsidies, federal, state and local. Testa Enterprises, Inc when accepting the public monies agreed contractually to abide by local, state and federal laws, especially the Fair Housing Act Amendment of 1988. Testa Enterprises, & many of their employees and agents made the choice not to abide by the government contracts Joel Testa signed willfully. I'm of the opinion that this is a company that believes that the disabled public that they contracted with the federal, state and local governments to serve in order to receive subsidies are of no consequence
