Prior to meeting and/or beginning work, I convey to every customer, verbally and in writing, my conditions for employment and other logistical details about their project which must be followed in order for the work to proceed smoothly. He or she must acknowledge receipt and compliance of a labor contract, my Terms and Conditions (on my website), as well as a detailed informational email covering virtually every aspect of the customers project from both a business and technical standpoint. I do not work for a customer who does not pre-approve or agree to comply with the contract and other pertinent information relayed to them. I tell every customer, in writing: -"Unpredictable expenses and complications are a natural component of home improvement work - and can occur at any point in the project." This customer's signed contract states the following: -“SCOPE OF WORK: Daily labor at Contractor and/or Owner’s discretion." *I did not install the fans because one of the ceiling mounts was loose. I am not comfortable installing a ceiling fan on a junction box that could potentially come loose while the fan is in operation. We agreed that I would install the fans at a later date. -"CONTRACTOR PRICE: Owner shall pay Contractor: For every day of service at Owner’s property, from arrival to departure: $250 minimum for up to 8 hours; plus *$35/hr. for overtime (per day), -"Owner retains the right to personally supervise and direct Contractor. During any time(s) in which Owner chooses to not supervise or direct Contractor, then Owner pre-authorizes all actions, expenses or materials which Contractor deems necessary to accomplish Owner’s stated work request in a manner which complies with known building codes; legal, safety or financial concerns or limitations; and generally accepted professional standards." *I offered to begin this project on a day that the customer would have been home, however she specifically asked me to work while she and other family members were gone. When she asked about removing the drywall, I said she was welcome to watch me work. -"Contractor provides no guarantee for the cost, quantity, quality or availability of necessary parts and materials nor the duration necessary to complete Project or task(s) in any span or increment of time." My Terms and Conditions contains the following clause: "Under no circumstances, without express written and/or oral permission or instructions from a customer, will the owner of this business knowingly, deliberately... perform any work-related action in an amateur or non-professional manner..." *The original backsplash was installed with glue. In my opinion, installing a new backsplash over dried glue is extremely unprofessional. *My instructions were to return after the cabinets were installed and reconnect the fixtures and appliances, therefore there was no reason for me to leave the job site prepared for another contractor to finish the project. As recently as 9 days ago, the customer and I communicated by e-mail in which I reiterated my intent to return to complete the work at the appropriate time. *I stated to the customer that while the old cabinets were out, it would be a good opportunity to clean and caulk the kitchen before the new cabinets were installed. She agreed. With the limited space to work with, I chose to relocate appliances so that I and the cabinet installers could more efficiently complete our work. To the best of my knowledge no damage befell any appliance. *The original shut-off valves were 'older' and not in ideal condition for reuse. Turning old valves can cause leaks which can destroy furniture and flooring. Cutting off the valves and capping the supply lines before I left allowed the cabinet installers to install the sink cabinet much more properly. If not, two large, unsightly holes would have to be cut in the floor of the sink cabinet to allow the valves to pass through. The new valves can easily be soldered in after the cabinets are installed. After my initial consultation with the customer, I made the following written statements to the customer: -"This e-mail, the attached contract and this website page outline my terms terms of employment and seek to eliminate or minimize complications before, during and after a customer's project. If you have any questions or concerns regarding any condition or disclosure therein, please express those to me before you attempt to hire me." -"Approving or signing the attached contract does not obligate you to employ me, nor me to start or complete any work." -"If you have a maximum labor-only budget for all or part of the work that we discussed, please convey that figure to me via text message or e-mail as soon as possible, and before I show up for work." *At no time did the customer state a budget for her project. -"It is your right to terminate my employment or modify the nature of your project at any time for any reason." *At no time did the customer terminate my employment or modify the nature of her project. -"I frequently work while customers are not at home. If you are curious or concerned about my activities or the progress of your project, you have the right and opportunity to personally watch me work or (re)schedule your work, personal activities or project work days in order to do so. In some cases, it is helpful, if not necessary, that the customer be physically present (or accessible by phone) to answer questions or make immediate decisions about critical issues that arise. If you allow work to take place while you are not physically present, it is by choice, not by force." *The customer specifically asked me to work while she was not present.
