Matthew built a new deck and put a new roof on my mom's house this past summer/fall. Prior to finishing the roof, he insisted on the balance of the money owed to be paid in full and told her he needed a check in the amount of $7,500. That amount was $5,000 more than she actually owed. Unfortunately, she made the mistake of not checking the balance still owed (only $2,500) on the contract before giving Matthew a check. She trusted that he told her the correct balance owed and gave him a check in the amount of $7,500. Later that night, she realized her mistake and left him a phone message. He showed up to work the next morning and agreed she only owed $2,500 and said he was surprised when she gave him a check for $7,500, but didn?t ask her about it. He said that he assumed the additional $5,000 was a "tip?. If that were the case, he never acknowledged it, nor thanked her for it. We asked him for the over payment back and he told us he had cashed the check an hour before, and spent the money already, so he didn't have it to give back. He eventually admitted that he had mistakenly told her the wrong balance owed amount, and that he would pay her back the $5,000. He did pay back $2,950 over the next two weeks, but it's been 3 months and he keeps promising, but has not come up with the $2,090 he still owes. Also, it was reported to him within a month of the new roof being put on, that there is a leak around the chimney. He came out and looked at it, but has not fixed it to date.
