I hired Mr. Davis to perform painting, baseboard, and flooring repair caused by water damage to multiple rooms in my condo. Mr. Davis failed to complete the agreed upon repair work in a satisfactory manner. Mr. Davis refused to return to complete the repair work, after which I informed Mr. Davis that the check $550 I wrote him would be cancelled, and that I was willing to send a smaller amount of $300 via PayPal for his time and effort. Mr. Davis agreed to accept the reduced payment amount within 10 minutes of my email communication. I discovered later a bank error had not cancelled the original $550 check, and Mr. Davis had cashed it, despite the fact that he knew of my intent to cancel it. I requested Mr. Davis' assistance in returning the overpaid amount of $550 on three separate days, and was ignored. I have formally filed a BBB complaint explaining these events in greater detail. Mr. Davis failed to respond to this formal complaint. I feel I am being ignored, ripped off, and unprofessionally treated, as I have paid Mr. Davis a total of $850 for incomplete and shoddy work. I find it appalling that Mr. Davis was fully aware of my intent to cancel the original check of $550, and yet he cashed the check anyway after I had paid him the reduced rate of $300. To me, this constitutes theft. I also find it infuriating that Mr. Davis responded in 10 minutes to accept my offer to pay him a lesser rate, but has repeatedly chosen to ignore my communication of an overpayment.
