Malone lawn care and irrigation

Mr. Malone was hired on July 23, 2014 to do the following://// Remove 6 pine trees and clean out all other undergrowth, while leaving the maximum number of desirable trees. Trees must be taken out because of the level of the newly installed dirt. Remove debris and haul to landfill. Bring in approximately 10 loads of red, packable clay to form a base layer for the new lawn area. Top dress with 4 inches if topsoil to provide the grass a suitable layer to grow into. Install 12 pallets of centipede sod. Remove logs from lake to a reasonable distance. Build a buffer type sea wall out of all treated material with galvanized lag screws. Tie backs would be installed to guarantee strength. The length of this wall is 200 ft. //// Of the items of this contract, the undergrowth was not cleared, at least one pallet of sod was not laid, the logs from the lake were not removed, and subsequently the lawn overlying the tie backs washed away from rain leaving gaping holes in the yard next to the sea wall. I've tried repeatedly via email and phone to get Mr. Malone to complete his contract, with no success. As of March of 2015 he no longer answers my phone calls or responds to my text messages. I've hired someone else to complete some of the work but the holes in the yard remain a serious problem.
