Jim took our $3,000 deposit, never showed up for work, refused to return our money My wife and I hired Jim from All Right Roofing in January, to perform gutter work on our house. He promised to begin work a few days later. Over the next two months, he would give very specific times when he would arrive at our house (e.g. "I will be there at 9am tomorrow..." or "I am on my way to your house right now") but never showed up to do any work, or even drop off materials he supposedly was using our money to purchase. He would tell us that he would definitely be here, then neither show up, nor call us to let us know he couldn't make it. I would have to ask him, "Jim, where are you?" and then sometimes he would give an excuse (after the fact) but usually he simply would not say anything. At one point, I told him, "If you don't want the job, we can just cancel the contract... just give me my money back... no hard feelings..." to which he responded, "No, man. I'll give you your money back in a New York minute, but I want the job... I'll be there tomorrow." He did not show up that next day, either. After a few more weeks of watching numerous sunny days in the 50 to 70 degree temperature range go by, without Jim showing up to work as promised, I finally said, enough is enough; we're done. We held up our part of the contract by giving him the whopping $3,000 he insisted on the day we signed the contract, but he never made any attempt to do the work we paid him to do. Jim agreed that we would terminate the contract, and he would give us our money back. He made an appointment with us to return the money by the end of the week. A mere 38 minutes before he was due at our house to return the money, I received an almost incoherent text message from Jim, saying, "Thought I would have all the money but it didn't work out that way I do apologise I know what I owe you willing to work this out at $1,000 next Friday and $1,000 to [sic] Fridays after that 3 Frost [sic] 3 weeks thousand dollars a week if not you can go ahead and sue me it'll just take me longer talk to you and not trying to be an ass or a jerk you around" Sifting through his garbled text (I'm still not sure what "Frost" was supposed to mean?) I gathered that he was telling me he wasn't going to make our appointment yet again, and was buying himself almost another month to return our money, without asking, and told me if I didn't like it, go ahead and sue him. I asked Jim to call me, so that we could discuss this, but he never responded in any way, even after I told him that by not returning my phone calls and text messages, this tells me that I can't trust him. We filed a police report, and a civil suit. He refused his certified mail, and evaded the police officer, and the constable attempting to serve him court papers. We are currently seeking criminal charges.
